Subject:    FINAL REQUEST Deposit Return

Dear Mr. Wesoloski,

Over the past 120 days, I have been in contact with various agents or your company. The most recent communication has been with Eddy Desir, whom I have spoken with numerous times, in regards to the return of my rental deposit for 6656 Swissco Drive, Orando, 32822 in the amount of $785.00.

As an attorney and president of two companies involved within the real estate industry, I am certain you are aware of landlord-tenant laws and your obligations to provide written statement of any possible withholdings within a 30-day period. Our lease agreement terminated on July 31, 2008. It has now been 90 days and I have not received a single communication from your company. Any contact has been initiated by me with no reciprocation. I have heard only empty promises of returned phone calls. I have seen no evidence to support any claims of a check being written.

I understand these are financially troubling times, and several units within the Courtney Landing complex are being foreclosed upon, however this should not hinder your ability to return money held as a rental deposit unless these funds have been commingled. I have suggested to Mr. Desir, as seen in the forwarded email below, that my next step will be to seek legal council. I have now done this and written a statement of claim to be filed with the Clerk of the Court.

I am offering you one final opportunity to contact me and remit $785.00. There is no reason we cannot settle this issue. Please contact me within the next five business days so that we may resolve this matter quickly.

Mr. Desir has all of my contact information, including telephone, email, and forwarding address, and they are also included below.
